These terms organise the relationship between SOMETIMES SRL and its clients. They are available before the order, and accepting them is required to conclude the sale.
Scope and seller
These terms apply to sales concluded on the Sometimes Passion website and, when they are expressly accepted, to distance sales concluded with the house.
The seller is SOMETIMES SRL, Rue Porte Haute 13, 6900 Marche-en-Famenne, Belgium, enterprise number 0800.394.708, VAT number BE 0800.394.708.
Vintage watches, description and authenticity
The watches offered are mainly vintage or pre-owned. Marks of time, earlier restorations and known particularities are described with the care reasonably expected of a professional.
Sometimes Passion certifies the authenticity of the pieces sold in light of the checks carried out. Wear parts such as crystals, bracelets, gaskets or crowns may have been replaced when keeping them was not possible or desirable. Any known information is given on the watch page or on request.
Photographs are contractual as to the piece shown, subject to normal differences in screen display. Unless stated otherwise, each watch is a unique piece.
Order, availability and price
The order becomes final after confirmation of full payment and sending of the order confirmation. A watch cannot be reserved for several buyers at the same time.
Prices are shown in euros, including VAT when it applies. Delivery costs are stated before confirmation. Taxes, duties and customs fees due outside the European Union remain the buyer’s responsibility.
In the event of an obvious price error or exceptional unavailability, the house informs the client and refunds without delay any amount already received.
Secure payment
The methods offered at payment go through Stripe: cards, Bancontact, iDEAL or Klarna, depending on the country. Only the methods actually shown at checkout are available for that order.
Card data is processed directly by the payment provider and is not stored by Sometimes Passion. For a payment outside the euro zone, the exchange rate and any fees of the client’s payment institution apply.
Preparation, delivery and security
Each watch is checked before dispatch and packed in suitable packaging. Delivery is entrusted to a recognised carrier such as UPS, Bpost, FedEx or an equivalent partner, with tracking and insurance when the service allows it.
The client must check the parcel on receipt and report any visible issue without delay to the carrier and to Sometimes Passion. Stated times are indicative, unless an express commitment says otherwise.
Right of withdrawal and returns
For a distance sale, the consumer has fourteen calendar days from receipt to notify the decision to withdraw, without having to give a reason. The legal period then applies for returning the piece.
The watch must be returned complete, protected and in the condition in which it was received. Handling beyond what is needed to assess its nature, characteristics and functioning may lead to a reduction in value. The cost and risk of the return are borne by the client, except for an error by the house or damage recognised on the outbound journey.
The refund covers the amounts that must legally be refunded and is made by the same means of payment, after receipt or proof of dispatch of the piece.
Workshop warranty and conformity
Unless stated otherwise, each watch comes with a twelve-month commercial workshop warranty covering its functioning and timekeeping within the reasonable tolerances of a vintage movement.
The following are excluded in particular: shocks, drops, magnetisation, misuse, work by a third party, cosmetic wear, the bracelet, breakage and water ingress when water resistance was not expressly guaranteed. This commercial warranty does not limit the consumer’s mandatory rights regarding conformity.
Personal data
The data needed for the order, payment, delivery, after-sales service and, in the iOS app, shipment notifications is processed by SOMETIMES SRL in accordance with the GDPR and the Belgian law of 30 July 2018. It is not sold. The detail is in the legal notice.
The client can delete the account and addresses from the client area, on the site and in the app, after a clear confirmation. Invoices and orders remain for seven years, the Belgian legal period, with the name, address, phone and email reduced to the country of delivery. Access, correction, objection and restriction are requested at [email protected].
Applicable law and disputes
Belgian law applies, without depriving the consumer of the mandatory protections of the country of residence. The parties favour an amicable solution. Any claim may be sent to [email protected].
If no agreement is reached, the competent courts are determined according to the legal rules that apply to consumers and professionals.
